1. Portée
Ces Conditions d'Utilisation s'appliquent à tous les services fournis par BuildMyDiscord. En utilisant nos services, vous acceptez ces conditions.
2. Étendue des Services
BuildMyDiscord offre un service de configuration automatisée de serveurs Discord. Le service comprend:
- Création et configuration de serveurs Discord
- Configuration des canaux, rôles et permissions
- Fourniture de modèles pour divers cas d'utilisation
- Optionnel: Fonctionnalités premium selon le plan choisi
3. AI Features and Usage Allowances
BuildMyDiscord includes AI-powered features (for example the AI server builder, the AI editor and the AI chat). The following applies to their use:
- AI features are subject to included-credit allowances that depend on the chosen plan; the current allowances are shown on the Pricing page and inside the product
- The number of credits consumed is cost-based and depends on the AI model and token usage across all provider calls needed to perform a request; one instruction can therefore consume credits for multiple provider calls
- Monthly included credits for paid plans reset at the start of each UTC calendar month; unused included credits expire at that reset and are not paid out or carried over
- Purchased credits are tracked in a separate balance, do not expire at the monthly reset and remain available across calendar months
- Automated, abusive or excessive use beyond the intended scope (for example scripted mass requests) may be throttled or blocked to protect service quality
- AI-generated content is produced by machine-learning models and may be incorrect or incomplete; users must review AI output before relying on it or applying it to their server
- The underlying AI models and providers may change, provided the contractually agreed scope of service is maintained
4. Conditions d'Utilisation

- Un compte Discord valide

- Le consentement pour utiliser notre bot Discord sur votre serveur
5. Tarification
Plan Gratuit
Le Plan Gratuit est gratuit et comprend des fonctionnalités de base pour configurer un serveur Discord.
Plans Premium
The Pro and Business plans are paid subscription plans. Current prices and the features included in each plan are shown on our Pricing page. Displayed prices are final prices; where value-added tax applies, it is included.
Conditions de Paiement
Paid subscriptions are billed monthly or annually in advance. Payment is processed by our payment provider Stripe; the payment methods available to you are shown during checkout. Subscriptions renew automatically until cancelled.
6. Right of Withdrawal
Consumers are entitled to a 14-day right of withdrawal under §312g BGB. Details and the model withdrawal form are available on our separate Withdrawal page.
The right of withdrawal expires early for digital services that the consumer expressly requests be performed before the end of the withdrawal period and explicitly acknowledges that they lose their right of withdrawal upon commencement of performance.
7. Résiliation
Vous pouvez résilier votre abonnement à tout moment avec effet à la fin de la période de facturation en cours. Après la résiliation, vous aurez accès à toutes les fonctionnalités premium jusqu'à la fin de la période payée.

8. Price Adjustments
BuildMyDiscord may adjust subscription prices with at least 30 days advance notice. Notice is given via the dashboard and/or Discord and, where an email address is on file, additionally by email. Affected customers have a special right of termination effective at the date the new price takes effect. Without termination, the new price applies from the next billing period.
9. Changes to Paid Services
BuildMyDiscord may adapt paid features for valid reasons, in particular technical development, changes at upstream providers (such as Discord or AI-model providers), legal requirements, or abuse prevention, provided the overall contractual scope of service is maintained and the change is reasonable for the customer. If a change materially reduces the scope of a paid plan, affected customers will be notified at least 30 days in advance via the dashboard and/or Discord, and have a special right of termination effective at the date the change takes effect.
10. Limitation of Liability
BuildMyDiscord is liable only for damages caused by intent or gross negligence. Liability for slight negligence is limited to breach of essential contractual obligations and to the foreseeable, contract-typical damage. Liability for damages from injury to life, body or health, and under the Product Liability Act remains unaffected.

11. Risque de Modification du Serveur
BuildMyDiscord applique des configurations directement aux serveurs Discord de l'utilisateur. Les structures existantes peuvent être modifiées ou supprimées définitivement dans le processus.
- Canaux, rôles et permissions peuvent être ajoutés, modifiés ou supprimés
- Discord ne fournit pas de fonction native de sauvegarde ou de restauration
- La sauvegarde de la configuration existante avant chaque installation relève de la seule responsabilité de l'utilisateur
- Avant chaque opération destructive, l'utilisateur doit reconnaître activement le risque ; cette reconnaissance est journalisée avec horodatage, hachage IP et hachage du texte (voir Politique de Confidentialité)
La confirmation explicite dans le flux de configuration constitue l'instruction de l'utilisateur de procéder à la configuration. BuildMyDiscord n'est pas responsable des pertes de données ou modifications non souhaitées résultant d'une configuration ainsi autorisée, sauf en cas d'intention ou de négligence grave de notre part.
12. Hébergement et Disponibilité
Pas de Droit à l'Hébergement Illimité
Il n'existe aucun droit légal à l'hébergement illimité du service. L'hébergement dépend des conditions techniques et économiques internes et peut être modifié ou résilié à tout moment. Le fournisseur n'est pas tenu de fournir une infrastructure d'hébergement permanente. L'arrêt du service est permis notamment si l'exploitation n'est plus économiquement raisonnable, par exemple parce que les coûts d'infrastructure continus dépassent les revenus totaux.
Résiliation en Cas de Fermeture de l'Entreprise
En cas de cessation des activités commerciales, de résiliation du service ou de discontinuation du fournisseur, les utilisateurs seront notifiés au moins 14 jours à l'avance. Les utilisateurs sont responsables de la sauvegarde de leurs données.
Pas de Responsabilité pour la Résiliation du Service
En cas de résiliation du service, le fournisseur n'est pas responsable des dommages résultant de la perte de données, d'accès ou d'hébergement. Cela s'applique aux abonnements gratuits et payants. Pour les abonnements payants, un remboursement au prorata de la période restante sera effectué.
Modifications des Services Gratuits
Les services gratuits peuvent être modifiés, restreints ou résiliés à tout moment sans préavis et sans aucune réclamation de compensation.
Exportation des Données
Les utilisateurs sont responsables de l'exportation régulière de leurs données. Après la résiliation du service, les données ne peuvent pas être récupérées.
13. Business Tier / White-Label Use
Business-tier customers using the White-Label feature to operate their own Discord bot ("Reseller") act in their own name and on their own account toward their end users. BuildMyDiscord is not a party to contracts between Reseller and end users and assumes no responsibility for compliance with consumer-law or Discord-Developer-Terms obligations on the Reseller side.
14. Modifications des Conditions
We may change these terms with effect for the future. Significant changes will be announced at least 30 days before they take effect via the dashboard and/or Discord. If you do not agree with a change, you may terminate your subscription effective at the date the change takes effect; continued use after that date constitutes acceptance of the amended terms.
15. Applicable Law and Place of Jurisdiction
Swiss law applies to the exclusion of conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer-protection provisions of the country in which the consumer has their habitual residence remain unaffected. Place of jurisdiction for merchants is the seat of BuildMyDiscord.
16. Severability
Should individual provisions of these terms be or become invalid, the validity of the remaining provisions shall not be affected.
